Why do I need IRS Representation?

In an adult’s life, little may seem more frightening or daunting than receiving a notice in the mail from the IRS. “What did we do wrong?” “How much do I owe?” “How will I ever pay this?” These are all common questions from clients who have received notices from the IRS about their personal income tax filings. From small problems to financial disasters, we are here to help you sort through the muck of what seems like a constantly building burden. If you owe money to the government you have a potentially very serious problem on your hands. Even if it takes a few years, the IRS will contact you and they will make you pay what is owed to them. There is little you can do yourself to escape the relentless collection process without lots of time and money.

What should I do first?

If you receive a notice by mail or phone, the first thing you as a client need to do is contact us. When dealing with the IRS on your own, fighting the notices can cost you more than the tax itself did! That’s where we come in; we understand the codes and we will work for you so you don’t have to avoid phone calls and live in fear of your finances. A good CPA is your protector, we work to find the most effective solution to rid you of your tax debt so you don’t have to become an expert in tax law.

What could the IRS want from me?

There are a few different reasons the IRS could be contacting you.

  • Failure to File
    There are many reasons a return might not have been filed. The first thing you need to do is gather your tax information and let us file your back returns. Until these returns are filed, we will not be able to help you minimize your back tax debt and penalties.
  • Audit
    The IRS decides to determine the accuracy of your tax return. Many think by handling an audit themselves they’d be saving money, but then run the risk of owing significant tax deficiency. IRS Auditors know how to get information out of you and they know most people are unaware of their rights. By coming to us, we will handle all communication with the IRS so you can focus on your life. Just send us the notice and we will take care of it.
  • Tax Liens and Levy
    The IRS says, “A levy is a legal seizure of your property to satisfy a tax debt. Levies are different from liens. A lien is a legal claim against your property to secure payment of your tax debt, while a levy actually takes the property to satisfy the tax debt.” What this means is that after a few notices, the IRS will alert you to the fact that they will soon be able to take some of your property in order to collect the back taxes. The Forms

As intimidating as the IRS can be, they will legally not be able to take anything from you until 30 days after the date of your FINAL NOTICE OF INTENT TO LEVY. Here is the order of the forms they will send you if they think you owe taxes.

Individual

  1. Notice CP14

    This is the first of your IRS contact letters. It will come by regular mail and will say “You have unpaid taxes” for a certain year and list any interest or penalties.

  2. Notice CP501

    This is the first reminder and second of your total IRS contact letters. It will come by regular mail and will say “You have unpaid taxes” for a certain year and list any interest or penalties.

  3. Notice CP503

    This is your second reminder of your unpaid taxes and last notice until they send you a letter of intent to levy. It will come by regular mail and will say “You have unpaid taxes” for a certain year and list any interest or penalties.

  4. Notice CP504

    This is your fourth total notice and now it is a notice of intent to levy. It will come by Certified Mail with a return receipt requested. The IRS legally can claim your state tax refund and it can be levied against your owed taxes. If that does not cover your taxes, they will move on the next notice.

  5. NOTICE OF INTENT TO LEVY AND NOTICE OF YOUR RIGHT TO A HEARING

    This is your fifth and final notice. It will come by Certified Mail with return receipt requested. What this means is that after 30 days from the date of this letter, the IRS can LEGALLY seize your assets such as property, automobiles, bank accounts, etc. to cover the taxes you owe.

An Offer in Compromise (OIC) is an agreement we would write that negotiates with the IRS to settle your debt for less than what you owe. We are well versed in OIC’s and have unbeaten results in settling our client’s debt.

Sometimes when a client can’t get their tax owed lowered, we are still capable of negotiating lower penalties and interest. Depending on the situation, sometimes clients can have these additional payments completely removed.

Sometimes the amount of money owed is not the issue, the payer just needs more time. We can help you negotiate an Installment Agreement that would allow you to pay small portions over a set period of time.
